Terms of Service

BANSO mail-order office (BANSO) determines the terms of service of its website under manage "sake-cb.jp BANSO"as follows.

Article1 The application range and modification of the terms
  • 1. The Terms regards to the provision and use of the service of BANSO and are applicable to BANSO and its customers (defined in Article3).
  • 2. BANSO has the right to modify the term without obtaining the customers consent in advance.
Article2 The use of our service
  • 1. Users must use BANSO service following the term and FAQs we have separetely determined.
  • 2. BANSO may modify service contents without notifying the users.
Article3 Users
"Users" are those who read, bought, used BANSO service. In addition, those who use our services shall be deemed as having agreed to the terms.
Article4 Suspension of our services and Rejection of purchase order

BANSO can suspend services to and reject purchase orders from users who correspond to either one of the following titles.

  • (1) When it is ascertained that the user has been suspended of our services or his/her purchase orders have been rejected as a measure in the past.
  • (2) When there is nonperformace by the user such as a delay in payment or other failures by the user.
  • (3) When the user commits an action that is prohibited (defined in Article7)
  • (4) When the user violates any other terms that are stated.
Article5 Prohibited Acts

Users are prohibited to commit actions listed below.

  • (1) Registering with false information and using false information in purchase orders
  • (2) Actions that obstructs the operation of our services and any other actions that may obstruct the operation of our services
  • (3) Abusing credit cards in any unlawful way to use our services
  • (4) Abusing e-mail addresses and passwords in any unlawful way
  • (5) Actions that cause or may cause disadvantageous positions or damages to other users and third parties and BANSO.
  • (6) Infingement of trademark rights, copyright, privacy or any other rights that belong to other users and third parties and BANSO.
  • (7) Actions that disturb or may disturb public order and morality, actions that violate or may violate the law.
  • (8) Any other action that BANSO regards as inappropriate and unsuitable

Commiting these prohibited acts are not merely breaking of etiquette rules, but are violations of criminal law, Act on the Prohibition of Unauthorized Computer Access, Trademark Act, Copyright Act, the civil law, commercial law. Those who violate the above laws will be held for criminal penalty and civil compensation responsibilities.

Article6 Copyright
  • 1. Without the approval of the rightful claimant, users cannot use any copyrighted information attained from our services beyond the lawfully allowed extent of private reproduction.
  • 2. If a violation to this provision by the user causes a dispute between the rightful claimant or third party, the user must resolve the problem with his/her own responsibility and expense. BANSO will not take any responsibility caused this way.
Article7 Use of User Information

Any user information attained by BANSO in the process of operation will not be disclosed without permission of users with the following exceptions.

  • (1) When the user approves the disclosure of user's name, address, gender, age, e-mail addresses.
  • (2) When BANSO creates statistics data in the purpose of understanding the uitilization trend of our services and provides this to third parties in forms of a set of anonymous data which cannot be identified to individuals.
  • (3) When in required situations in our services (situations such as disclosing names and addresses to shipping companies in order to deliver products to customers)
  • (4) When in other situations that disclosure is allowed or required by guidelines.
Article8 Purchase of Product
  • 1. Users may purchase products though our services.
  • 2. Users must send a purchase order in the methods that BANSO has specified, if the purchase of product is desired.
  • 3. The purchase order mentioned above, refers to the act of clicking on the purchase button. At this point, a sales contract regarding the product is formed between the user and BANSO.
  • 4. Regarding the second clause about the order cancellation, this clause follows the separately established terms in "Return and Exchange of Goods".
Article9 Cancellation of Contact
  • 1. The arise of any one of the following causes will enable BANSO to cancel contracts.
  • (1) When the user violates the Terms of Service.
  • (2) The credit card company of the user has notified BANSO of a credit default.
  • (3) When BANSO has ascertained that the user's solvency is doubted.
  • (4) When the product is sold out and is not available for delivery.
  • (5) When the delivery is obstructed because delivery address is unknown or from a long term absence at the specified address.
  • 2. Without regard to the above provision, BANSO is able to cancel or take any appropriate measures in case of the commitment of unlawful or inappropriate actions by the user.
Article10 Payment
  • 1.The payment amount for the purchase amount for the product is the sum amount of product purchase price and shipping charges and sales tax.
  • 2.The payment of the product purchased in our services can be made by the credit card owned by the user.
  • 3.In the case of payment by credit card, the contract and provision between the user and card company are to be followed.

In case of a dispute uprising between the user and card company, the problem should be solved between the user and the card company and BANSO will not take any responsibility.

Article11 Return of Products
  • 1. The return of products are not accepted except in situations regarding damages done in delivery, product defects, mistakes in product delivery, and other situations that BANSO approves. The return of products and the cancellation of contract caused by a exchange or non-exchange of products with defects are allowed only if the product was returned within the period of time that BANSO specifies.
  • 2. The users must follow the method seperately stated in "About Return and Exchange of Goods" when returning the products.
Article12 Managing of Information
  • One Touch Nail can delete any comment or other information emitted by users without any permission from users in any of the following situantions.
  • (1) When we have found that information emitted by users infringe the rights of third parties or BANSO or impair the credibility or reputation of third parties or BANSO.
  • (2) When we recieve notification that information emitted by users infringe the rights of third parties or BANSO or impair the credibility or reputation of third parties or BANSO.
  • (3) When emission of the information by users violate Japanese law or applicable law of other countries.
  • (4) When BANSO recieves a order from governments or public agencies to delete the information.
  • (5) When emission of information by users are inapporpriate or destructive to the operation of our services.
  • 2. BANSO can reject any access of certain users to certain parts or to the whole website without any notice to the user and in our own discretion.
Article13 Suspention of Services

In order to maintain our service in a favorable condition, BANSO can suspend a part or the whole service without any notice to our users in advance in case of the following conditions.

  • (1) When suspension of services is necessary for periodic maintenance or emergency maintenance.
  • (2) When operation of the system becomes difficult though fire, power failure, obstruction by third parties or other problems.
  • (3) When any other incident occur that BANSO may decide that there is a need for suspension of services.
Article14 Other Discliamers
  • 1. In circumstances where BANSO is obligated to the duty to give notice to users, BANSO fulfills this duty by sending a notice to the email address specified by the user or in case of product delivery, BANSO fulfills this duty by delivering the product to the address specified by the user.
  • 2. BANSO does not take any responsibility for any damages, losses, disadvantages related to the products that are sold or bought though our service or the use of our service that are not mentioned in the preceding articles without concern to the type of legal claim mentioned in the preceding articles in any cases.
  • 3. BANSO does not take any responsibility for any losses caused by the suspension of our services.
  • 4. BANSO will not be held for responsibility by carrying out operations utilizing the user registered information.
  • 5. BANSO does not take any responsibility for any damages, losses, disadvantages related to our service or the use of our service without concern to the type of legal claim mentioned in the preceding articles in any cases.
  • 6. In cases when certian users cause damages to other users or third parties in some way related to our services, these users are responsible to resolve these disputes at their own responsibility and their own expense and BANSO takes no responsibility.
  • 7. The users themselves bear the necessary expenses required to use our services such as the set up costs of computers and other telecommunication equipment or telephone service charge cost or LAN related costs.
  • 8. The browsers that users need to use our services are as follows.

Article15 Other Provisions
  • 1. Communication between BANSO and the user are to be by email and telephone generally.
  • 2. In case of occurance of a dispute or problem that is unresolvable though the application of these terms of service, BANSO and the user are to negotiate in good faith and resolve the matter.
  • 3. If BANSO faces a need for litigation related to a dispute concerning our services, Tokyo District Court will be the court of first instance with the exclusive jurisdiction.
  • 4. If the user officially assumes compensation obligation though violation of these Terms such as nonpayment of purchase charge or other violations, attorny's fees caused by the dispute for BANSO will also be a responsibility of the violating user.

The effective date of this Terms of Service is December 1st, 2016.
